Article 1 — Definitions
In these terms and conditions, the following definitions apply:
- Trader: Taste Filipino B.V., established in the Netherlands, registered with the Dutch Chamber of Commerce.
- Consumer: any natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the trader.
- Distance contract: a contract concluded by exclusive use of one or more means of distance communication.
- Cooling-off period: the period within which the consumer may exercise their right of withdrawal.
- Right of withdrawal: the consumer's right to withdraw from the distance contract within the cooling-off period.
Article 2 — Applicability
These terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer. Deviations are only valid if agreed in writing.
Article 3 — The Offer
All offers on the website are non-binding. The trader reserves the right to modify and adjust the offer. Obvious mistakes or errors in the offer are not binding on the trader.
Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to acceptance of the offer. This includes in particular the price inclusive of taxes, any delivery charges, and the method of payment, delivery and performance of the contract.
Article 4 — The Contract
The contract is formed at the moment the consumer accepts the offer and fulfils the conditions attached thereto. The trader shall confirm receipt of the acceptance of the offer electronically without delay.
The trader may — within statutory limits — verify whether the consumer can meet their payment obligations, as well as all facts and factors relevant to entering responsibly into a distance contract.
Article 5 — Right of Withdrawal
When purchasing products, the consumer has a cooling-off period of 14 days to withdraw from the contract without giving reasons.
Exception for foodstuffs: Pursuant to Article 16(e) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons where the seal has been broken after delivery. This applies to our ube and pineapple powder once the packaging has been opened.
Unopened products in their original, undamaged packaging may be returned within 14 days of receipt. Return Policy.
Article 6 — Price
All stated prices include VAT. Any delivery charges are stated separately prior to completion of the order. The trader reserves the right to change prices; changes do not apply to contracts already concluded.
Article 7 — Payment
Payment is made via the available payment methods at the time of ordering. The consumer is obliged to report any inaccuracies in payment details without delay. The trader processes payments via Stripe Inc. and does not store any payment data.
Article 8 — Delivery
Orders will be delivered as soon as possible, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified as soon as possible.
The risk of damage and/or loss of products rests with the trader until the moment of delivery to the consumer or a representative designated in advance and made known to the trader.
Article 9 — Complaints
The trader operates a sufficiently publicised complaints procedure and handles complaints in accordance with that procedure. Complaints must be submitted in full and clearly described within a reasonable time, but no later than 14 days after discovering the defect, via hello@tastefilipino.com.
Complaints will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, an acknowledgement of receipt will be sent within 14 days with an indication of when the consumer can expect a more detailed response.
Article 10 — Liability
The trader is not liable for damage caused by the consumer having provided incorrect or incomplete information, nor for circumstances not attributable to the trader. The trader's liability is in any event limited to the amount paid out by the liability insurance in the relevant case, or — in the absence of an insurance payment — to the invoice amount.
Article 11 — Governing Law and Jurisdiction
Dutch law exclusively applies to all contracts between the trader and the consumer to which these terms and conditions relate. Disputes shall be submitted exclusively to the competent court in the district where the trader is established, unless the law mandatorily designates a different court.
